Terms of Service

01The agreement

These Terms of Service ("Terms") are a binding agreement between you and Outdoor Innovations LLC ("we," "us"), the operator of the Guide Optik app and this website. By creating an account you accept these Terms and our Privacy Policy. If you don't agree, don't create an account.

These Terms act as the end-user license agreement for the app: we grant you a personal, non-transferable, revocable license to use Guide Optik on Apple-branded devices you own or control, as permitted by the Apple App Store's Usage Rules.

02The service

Guide Optik is a working tool for professional fishing guides and hunting outfitters: live water, weather, and tide conditions drawn from public U.S. government sources; waypoints; a trip calendar; expense tracking; document storage; and a guide network for referring trips.

Guide Optik is currently offered without charge. We may introduce paid plans in the future; if we do, we will give you clear notice and pricing before anything is billed, and these Terms will be updated for your acceptance.

03Your account

• Provide accurate information and keep your credentials secure — you are responsible for activity under your account.
• One person per account. Don't share logins or transfer your account.
• You must be at least 18 to create an account.
• Tell us promptly at info@guideoptik.com if you believe your account has been compromised.

04Your content

You own your data. Waypoints, trips, client records, guide contacts, expenses, documents, and photos you put into Guide Optik remain yours. You grant us only the limited license needed to operate the service: to store, sync, back up, and display your content to you (and to a guide you refer a trip to). We do not use your content for advertising, sell it, or use it to train AI models.

You are responsible for what you store — make sure you have the right to upload it and that it doesn't infringe anyone else's rights.

05Client data & the guide network

When you enter clients' names and contact details, you represent that you may lawfully store that information with us. When you refer a trip through the guide network, the trip's details — including the client's contact information — are shared with the guide you select. You are responsible for having your client's permission to make that handoff.

If you receive a referred trip, you may use the client's information only for that trip and must handle it at least as carefully as these Terms and our Privacy Policy require.

06Acceptable use

Don't misuse the service. In particular, you agree not to:

• probe, interfere with, or circumvent security or the per-account isolation of data;
• access or attempt to access another user's data;
• scrape, resell, or redistribute the service or its data feeds as a product;
• use the service for anything unlawful, including violations of fish and game regulations;
• overload or disrupt the service or the public data sources it relies on.

07Safety disclaimer

River flows, stages, weather, buoy, and tide readings in Guide Optik come from third-party sources — USGS, NOAA, NWS, NDBC, and NOAA CO-OPS — and are provided as-is, exactly as those sources publish them. Gauges fail, transmissions lag, forecasts miss, and conditions change faster than any feed updates. A reading in the app may be wrong, stale, or unavailable at the moment you need it.

You are a professional operating in environments that can kill. Never rely on Guide Optik as your sole basis for deciding whether water or backcountry conditions are safe. Verify conditions independently, follow your training and local knowledge, and exercise your own professional judgment. We are not liable for decisions you make — on the water, in the field, or anywhere else — based on information shown in the app.

08Warranties & liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA FEEDS WILL BE ACCURATE OR AVAILABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTDOOR INNOVATIONS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST BOOKINGS, LOST DATA, OR PERSONAL INJURY ARISING FROM RELIANCE ON CONDITION DATA (SECTION 07). OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain exclusions or limits; in those places, these apply to the fullest extent permitted.

Back up what matters: keep independent copies of critical documents (licenses, permits, insurance). The in-app copies are a convenience, not your system of record.

09Apple App Store terms

Because you obtained Guide Optik through Apple's App Store, the following also apply:

• These Terms are between you and Outdoor Innovations LLC only — not Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to furnish any maintenance or support for the app.
• If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are our responsibility.
• Apple is not responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and consumer-protection or similar claims.
• If a third party claims the app infringes their intellectual-property rights, we — not Apple — are responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms (for example, your wireless data agreement) when using the app.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.

10Termination

You can end this agreement at any time by deleting your account in the app (Menu → Account → Delete account), which permanently erases your data, or by emailing us. We may suspend or terminate accounts that violate these Terms; where practical we'll warn you first. Sections 04 (license back to you ends), 07, 08, 09, and 11 survive termination.

11Governing law & changes

These Terms are governed by the laws of the state in which Outdoor Innovations LLC is organized, without regard to conflict-of-laws rules. Disputes will be resolved in the state and federal courts of that state, and you consent to their jurisdiction.

If we make material changes to these Terms, we will update the effective date above and ask you to review and accept the new version in the app before continuing. The current version always lives at this URL.
